Arizona DUI, or Driving Under the Influence, is the criminal charge of operating a motor vehicle while impaired by drugs or alcohol. In other states, this is sometimes called DWI or Driving While Intoxicated. In Arizona especially, a DUI conviction can carry harsh penalties from fines, suspension of your driver’s license, to jail time. It’s important to seek skilled representation.

What is a DUI?

A DUI charge is based upon a person’s ability to operate a vehicle and/or their blood alcohol concentration (BAC).  Under Arizona DUI State law, any driver who is pulled over and determined to have a BAC level over 0.08% is considered to be intoxicated and can be charged with DUI. For commercial truck drivers, this number lowers to 0.04%. And for any driver under the age of 21, any trace of alcohol can result in a DUI. Arizona maintains a statute that defines the different classifications of DUI; that Statute is ARS 28-1381.

Exact penalties for a conviction can vary, based on the type of DUI charged, and the defendant’s previous criminal record.
